Recently, it was discovered that additional learning data for image-generating AI is being sold online to create images that resemble real minors. Among this data, those of former Japanese child actors were found, and the images generated with this data, which contain sexual content, are also being marketed on separate websites.

Image-generating AI works by learning from a large amount of visual data, allowing it to generate detailed images simply by being given textual instructions. While it’s generally difficult to create images that resemble specific people by typing in just their names, some AI systems can achieve this by learning additional data, known as “LoRA&#8221” files.

The Yomiuri Shimbun newspaper identified an English-language website that sells this additional data on several domestic and international children's artists at a price of around three dollars in cryptocurrency per file. Data on adult women was also found for sale. Sexual images generated from this data of Japanese child performers were sold for several hundred yen on another Japanese website.

Creating sexual images from children's data raises serious legal concerns. According to Japan's Ministry of Justice, the Child Pornography Prohibition Act requires that the victim be actually a minor for the law to apply. While computer-generated images that resemble real minors can be regulated, experts say AI-generated images may not fall into that category if they do not completely resemble the physical characteristics of real minors, leaving a gap in the law.

Takashi Nagase (長瀬貴志), former judge and professor at Kanazawa University, highlights that “The misuse of AI and additional data has revealed a violation of the rights of minors. There is a risk that the damage will expand beneath the surface. The situation is not covered by current laws, so specific legislation needs to be considered to regulate AI-generated sexual images of minors.“.

The advancement of AI technology has brought numerous benefits, but it also presents serious ethical and legal challenges. The ability to generate realistic images of minors with inappropriate content highlights a serious threat to the protection of children’s rights. It is imperative that appropriate legislative measures are implemented to address these new types of exploitation and ensure that emerging technologies are not used to harm the most vulnerable. International cooperation and constant updating of laws will be essential to effectively address these challenges.
